Lawsuit Decisions in EPIC's lawsuit against the TSA

    I just noticed that there has been some activity by EPIC:

    I see from reading this that EPIC's request for a rehearing by the DC Appeals Court was denied on September 12. This is the first I have heard of this. I wonder why EPIC did not post an update at the time. In the past, it seemed that they would post updates whether the news was in their favor or against.

    Does this mean that the only remaining recourse is an appeal to the Supreme Court? Presumably that could proceed independently of EPIC's attempt to force the TSA to conduct the public comment process (?).

I suspect that the DHS defense will reply with some such blather: "We deployed and started using the latest and greatest technology in response to an imminent threat to aviation security by one-lone-nut-job-panty-bomber and, of course, because of a <whispering softly> secret executive order </whispering softly>." :confused:

    I think the Judge should hold heads of DHS and TSA in contempt and jail them until after a comment period is completed.

    That being said I doubt any change will come about comments or no comments. TSA has gone all in on keeping the Strip Search Machines regardless of what the public thinks or wants.

    ...and as soon as Congress thought we weren't watching any more they upped the TSA's budget to buy even more.

    I can't wait to vote those creeps out of office.

    Seriously. I'm half-tempted to bring one of those pen cameras into the voting booth and videotape myself voting "FOAD" for every incumbent candidate on the ballot, just so I can take it home and rewatch it again and again and again and again and...
