How can he get away with displaying her picture and her name? She's a juvenile, for G-d's sake!

    I found my answer:

This poor girl is screwed, simply screwed.

Based on this part of the article you quoted ...

I would expect court affidavits to be public (at this point in her case there might not be any), but probably not her mugshot and definitely not any PR from police chief.

Accusing a 16-year-old bullying victim of terorism is still a farce any way you look at it.

I'm thinking that Chief Jim Clark is the terrorist in Ottumwa.

Chief Jim Clark defends his actions:

    Arrogant SOB.

He's still an arrogant (expletive deleted). If he hadn't issued press releases and caused her mugshot to be plastered all over the country, he might be able to make his case.

A couple interesting new comments on the Facebook page of itty bitty Police Chief Jim Clark:

Cheyenna Robin Clouse I was bullied ever since I moved to this damn town. I did speak up. Nothing was done. Although I never planned anything drastic such as what Emily is being accused of, I thought of it many times. At that age, your mental state is so extremely delicate... it's extremely easy to be pushed over the edge. I'm not saying she's guilty or not (although, yes, she probably DID say something stupid to the wrong person...), however, I do hope that they give her a thorough mental evaluation to see what in the (expletive deleted) is going on, if anything. But... I can sympathize if the findings come out as just a huge overreaction... I got accused of making a bomb threat because I made a joking comment in passing during finals week that I felt like my head was going to blow up, and I "wasn't made up how I normally was" on the day that I made the comment...
Cheyenna Robin Clouse You know what they say about the word "assume!"

The Ottumwa paper doesn't appear to accept comments, but you can leave a piece of your mind on itty bitty Police Chief Jim Clark's Facebook page.

Too many Senators and Representatives hold stock in the diaper industry.

Arresting people in case they might commit a crime is unconstitutional. It's now been a week since his big terrorism investigation and arrest. Where's the details of the crime, Police Chief Jim Clark? Do you actually have any evidence that a real crime was committed?

If her family plays their cards right, Police Chief Jim Clark & the City of Ottumwa will be funding her veterinary education.

    Update this morning ....

Journal Express (29 Dec 2011): Father hopes accused girl is treated fairly

Big problem with conspiracy charges is that it takes more than idle chatter to make a case. At this point Ottumwa Police Chief Jim Clark seems to be searching desperately for the evidence to support his big tewwowist arrest.

At least she has an attorney. That question is finally answered.

Reading between the lines here, I'll bet the father is actually livid but the attorney has told him to stifle himself.

Which means that short of filing habeas corpus & pushing the issue, there's not much the attorney can do at this point.

I really doubt there is is a case. They're just fishing. My bet is that they'll end up dropping it or looking like asses in court.

They are holding her without charges, without evidence, without bail, indefinitely ... in America?

Yes, you can overreact, you moron. Try reading the constitution.

What a total dip. Reciting statutes doesn't make a case against anyone. You have to have evidence that the suspect is in violation of those statutes, and the statutes themselves have to be constitutional, which is likely to leave this case walking on very thin ice.

    S.1867 to the contrary...

S.1867 is also unconstitutional. It will just take time to hash it out.

Maybe Chief "what an idiot" Clark didn't realize that the Minority Report was fiction.

Sure! The NDAA says she's a Big Scary Terrorist!

Speaking of which, I just finished "It Can't Happen Here" by Sinclair Lewis. Published in 1935 and still relevant today. In fact, I have "TSA" and "DHS" scrawled in several places in the margins. Highly recommended.

first objective, get the client out of jail, second, keep her out of jail.... If there was an abuse of due discretion here, I'm sure the lawyer will be all over it...unless like in a lot of small towns, the legal people, the judges, and law enforcement are one big happy family.

This is the guy who is teaching teachers. No wonder our country's education system is turning out people who are unemployable.

Well, the TSA needs more idiots to expand into bus stations and train stations... If the kids actually had an education, they'd get real jobs.
