I never log into news sites (including the NYT) that want any kind of info from me, so I can't see who wrote the article. But - crashing the system this way was something that is discussed all through law school. In civil cases everyone is encouraged to try mediation, settling, anything, before going to trial. Same thing with criminal cases. And then there's arbitration (don't get me started).
