Yep - this is what jury selection is all about.
They could, yes. It's also very possible that the jury could rule in her favor but only in a very narrow way - essentially the ruling would be for this set of facts. If they did that then the ruling wouldn't be something we could use very easily in future cases.

Unfortunately true. I went through the jury selection process but was not selected for a local child abuse case:
One juror was the hold-out on five counts. One charge resulted in a guilty verdict. So, mistrial on the other five.
I do not have a trial date yet. I should find out my date in May. I will keep you updated.
UPDATE: Current Assistant District Attorney has my case under advisement, to pursue the case or not.

I'm sorry you've had to wait so long. I hope no evidence of the groper's and police "officer's" malfeasance has been lost during all this time. I remember the video recordings very well. They provide excellent witnesses to just how badly you and your daughter were abused.

I received this today.
"We had a pre-trial settlement conference today. The District Attorney offered a 30 day pre-trial diversion. That simply means that upon agreement by you, they will enter into an agreement with you that if your conduct for that 30 days is good and lawful the charges will be dismissed and the case expunged. There is no requirement of any type of guilty plea, not even a no contest plea. You simply agree that you will enter into a 30 day period in which you must remain lawful and in return the case is dismissed.
This is simply their way of dismissing the case without having to much egg on their face.
You would probably have to pay court costs but I can probably get an agreement that you do not even need to come back to court and the court costs will be less than the airplane flight.
Let me know if you want to do this. I think you should."
SOP for these bozos. They step all over you, take it up to the brink of a court case, but they know if they actually GO to court, they'll get their (expletive deleted) handed to them.
So they put people through the wringer, arrest, threaten, belittle them, charge them time and energy and court fees, and because everyone takes the first exit on the left when they offer it, it never goes to court and they never get shut down.
For the record, I would completely understand from a personal level if you took the deal. It ends the ordeal for you, with a minimum of fuss, and you don't even have to have it on your history.
Unfortunately, this is what they rely on - people looking out for themselves. It's the last, twisted, perverted twist of the knife that they rely on someone looking out for their own self interest to let them live to screw with someone else another day.
