NYPD Testing Gun-Scanning Technology

    How do the NYC cops get away with "stop and frisk" which this technology is allegedly going to replace?

    The lawsuits are wending their way through the courts.

    A lot of the cases are based on alleged racial profiling. If the courts agree that the stops are based on racial profiling and not on any kind of reasonable suspicion, the practice will stop.

    Also... some of the articles I've read on the subject point to people not knowing their rights. If a cop comes up to you and says 'empty your pockets', you don't have to do it. I understand that it's a very intimidating experience to have a cop come up to you like that, but the correct response from you should be "am I being detained?" If the cop says 'no', then you're free to leave - and you should do so.

    A lot of people just empty their pockets, and if they have drugs or weapons they get arrested. They've consented to the search.

    I think she was referring to the situation of being a person of color and asking the cop if you're being detained, and if the cop says 'no' you walk away.

    I could easily see how a cop would just shoot that person and then make up a story about how the guy was trying to flee. That's the risk.

    But the good news is that when this is deployed, we will see an increase in cop-on-cop shootings, NYPD being what it is.

    The answer is not Terry. The NYPD conducts stop & frisks that are completely outside the law & the Constitution.

    Given the number of NYPD officers that are on the take or operating outside the law (e.g. these unconstitutional stop & frisks), this could actually be an effective crime reduction program.

    Unfortunately when you give Bonzo high tech tools as well as guns, the current situation with collateral damage will get even worse.
