Not to toot my own horn, but I cited this very same argument in my comments:

Of course, I didn't use such scholarly wording, but the thought was the same.

I wonder how long we are going to have to wait for the TSA's response.

Since we have watched TSA closer than most, none of us will be surprised will be surprised if TSA comes back with something along these lines:

    1. We have added privacy software to all of the scanners. (As to imply they had a choice.)
    2. We have modified our patdown procedures for children under 12 and passengers 75 and older. ( Without explaining why they continue to harass those between 12 and 75.)
    3. We have added Precheck lanes at most major airports. (Without mentioning that this only applies to only a dozen or so of the hundreds of airports nationwide.)
    4. Over 3 million people have used Precheck since we opened the program. (They will ignore the fact that this was over a two year period and that there are less than 2 million members out of 350 million citizens and millions of foreign travelers.)
    5. Our procedures continue to evolve in response to new threats and are constantly reviewed to assure that every traveler is treated with respect and dignity. (As usual the "threats" and "improvements" will be so vague that they cannot be measured.)
    6. Once prepared, their response will be withheld until a some incident gets them in the news again, at which time they will release the response as cover to offset the damage.

Then again they may go with Frank's guess, which is essentially the gist of what I added here.

    No doubt.
    To add:
    7. We have removed all scanners using backscatter x-ray.
    8. We have added "Passenger Screening Specialists" to aid the disabled.
    etc...
Try as they might, they are still in a world of hurt on legal challenge.
