Righthaven ordered to pay nearly $120,000 in attorney fees, court costs

    How did they come to own the rights to that picture. Would it be a case of buying the image from the maker?

    All they "bought" was the right to sue. Their plan was simply to shake down people with lawsuits and threats of lawsuits. But copyright law requires a suit by the owner of the image, and Rightshaven didn't own the image. (Means they had no right to sue. Oops.) On this issue, they lied to the court, and this is what drew them well-deserved sanctions.

    BTW, this is a good reason never to read the Denver Post if you ever do. Freakin' dead-tree newspapers got nothing to complain about if this is the way they do business.

    If the Denver Post was party to this abuse then I would suggest a total boycott of that rag. They don't deserve any customers.

    Even worse, they only went after the "little guys" who for the most part didn't have the means to fight a federal lawsuit but often settled for several thousand, for using a few lines or a photo in a blog which (in its entirety) might only net a few dollars (or less) annually in revenues.

    Thank god, I'm following this whole train wreck as I have 5 separate copyright actions pending(1 of which will be a blood from a turnip piece but its more principal then money), and I have been holding off because of the whole rightsheaven debacle and some of the associated fall out for legit copyright holders.

    The photo is now being used on the Andrea Abbott is a Hero Facebook page with this caption:

    "Don't touch my junk and don't even think about my kid!"

    I'm no copyright lawyer, but it seems to me that the image has become associated with the abuse of government power, which I think broadens up the ability of people to make fair use of it under the copyright law.

    As a standalone thread, I don't think this belongs in aviation security. We'll try civil rights (freedom of press) unless someone has a better suggestion.
