    I see you and Wendy did a great job of exposing the stupid on this. I left a few hits and a comment.

    It irritates me though that some HuffPo readers, who are usually fierce TSA opponents, seem to switch sides when Rand Paul is involved. If this came from Claire McCaskill (who became a critic after her groping) would the comments be the same?

    Kent v. Dulles is directly relevant those who would claim that flying is a privilege, we can always take a bus, train, boat, whatever instead of flying.

    Kent v. Dulles was written in the 1950's and involved travel by ship to destinations which today are only practical to reach by air. By 1960 air travel was dominant and most of the large passenger liners to headed to the scrap yards.

    In the holdings at the top of the decision, the "right to travel" was the very first of the holdings to be enumerated:

    It's correct that the specific cause of action in Kent V. Dulles was the State Department's "discretionary" refusal to issue a passport, but the decision very clearly lays out the right to travel and that for the government to abridge that right without due process is unconstitutional.

    Yes, I have been, multiple times. I just keep hammering away with the facts and she just keeps denying. TUGers have stepped forward, too.

    Oh, and I left Mike's Kent v. Dulles excerpt -- it fit, just barely -- HuffPo has a word count limit. So at least people will see that.
